Los beneficios pueden incluir atenci\u00f3n m\u00e9dica por la lesi\u00f3n, beneficios salariales de indemnizaci\u00f3n, servicios de rehabilitaci\u00f3n vocacional o beneficios por fallecimiento. Estos beneficios son obligaci\u00f3n del empleador y son pagados directamente al empleado por el empleador o su aseguradora de compensaci\u00f3n para trabajadores. Todo empleador, a menos que est\u00e9 legalmente exento, es responsable de la atenci\u00f3n m\u00e9dica y el pago de beneficios salariales de indemnizaci\u00f3n a cualquier empleado que se lesione en el curso y alcance de su empleo.<\/p>\n<p>Los empleadores deben tener un seguro de compensaci\u00f3n para trabajadores o estar aprobados para autoasegurarse por el estado. La mayor\u00eda de los empleados en Luisiana est\u00e1n cubiertos desde el primer d\u00eda que comienzan a trabajar. Los empleados pueden ser de tiempo completo, de medio tiempo, de temporada o incluso menores de edad para estar cubiertos por la protecci\u00f3n de compensaci\u00f3n para trabajadores. La mayor\u00eda de los trabajadores voluntarios tampoco tendr\u00edan derecho a los beneficios de compensaci\u00f3n para trabajadores.<\/p>\n<p>Dentro de los 10 d\u00edas posteriores al conocimiento real de una lesi\u00f3n en el trabajo que result\u00f3 en la muerte o p\u00e9rdida de tiempo de m\u00e1s de una semana, el empleador debe informar la lesi\u00f3n a su aseguradora en un&nbsp;<a href=\"https:\/\/www.laworks.net\/Downloads\/OWC\/IA_1Form.pdf\">Formulario LWC-WC IA-1<\/a>&nbsp;(Primer Reporte de Lesi\u00f3n o Enfermedad). El asegurador luego enviar\u00e1 el informe a la&nbsp;<a href=\"https:\/\/www.laworks.net\/\">Oficina de Administraci\u00f3n de Compensaci\u00f3n para Trabajadores<\/a>&nbsp;(OWCA). Sin embargo, una lesi\u00f3n mental debe ser el resultado de una lesi\u00f3n f\u00edsica o de un estr\u00e9s repentino, inesperado y extraordinario relacionado con el empleo y, en cualquier caso, debe probarse mediante pruebas claras y convincentes.<\/p>\n<p>Un accidente se define por la&nbsp;<a href=\"https:\/\/law.justia.com\/codes\/louisiana\/2011\/rs\/title23\">Ley de Compensaci\u00f3n para Trabajadores de Luisiana<\/a>&nbsp;como un evento inesperado o imprevisto real, identificable y precipitado que sucede repentina o violentamente. Esto puede ser con o sin culpa humana, y produciendo directamente en el momento hallazgos objetivos de una lesi\u00f3n que es m\u00e1s que un simple deterioro gradual o una degeneraci\u00f3n progresiva.<\/p>\n<p>Una enfermedad profesional se define por la&nbsp;<a href=\"https:\/\/law.justia.com\/codes\/louisiana\/2011\/rs\/title23\">Ley de Compensaci\u00f3n para Trabajadores de Luisiana<\/a>&nbsp;como \u00fanicamente aquella enfermedad o dolencia que se debe a causas y condiciones caracter\u00edsticas y peculiares del oficio, ocupaci\u00f3n, proceso o empleo en particular en el que el empleado est\u00e1 expuesto a tal enfermedad. El evento que caus\u00f3 la lesi\u00f3n debe surgir y estar dentro del curso y alcance del empleo del empleado.<\/p>\n<p>Generalmente, la culpa del empleador o de los empleados no afectar\u00e1 la compensaci\u00f3n de una lesi\u00f3n; sin embargo, no se permitir\u00e1 ninguna compensaci\u00f3n si la lesi\u00f3n fue causada por la intenci\u00f3n deliberada del empleado de lastimarse a s\u00ed mismo oa otros; o por la intoxicaci\u00f3n del empleado lesionado en el momento de la lesi\u00f3n.
